Jimmy John’s serves up a lesson on how not to treat your employees

Your company may have non-compete clauses, and in some cases, I support those. After all, you don’t want your top widget salesman to leave today and go to the competitor widget maker and take all your clients with him, but what about the guy that makes your sandwiches? Should he have a non-compete clause in his contract?

The Huffington Post reports that sandwich restaurant Jimmy John’s makes their entry level people sign a non-compete agreement that is surprisingly broad. It’s not just that employees can’t walk directly across the street and accept a job from Subway, they are limited for two years from working for any restaurant that derives 10 percent or more of their revenue from sandwiches or similar, if that restaurant is within a 3 mile radius of a Jimmy John’s. As article author Dave Jamieson says, “It isn’t clear what sort of trade secrets a low-wage sandwich artist might be privy to that would warrant such a contract. A Jimmy John’s spokeswoman said the company wouldn’t comment.”

  1. This is disgusting. I already gave up on Jimmy John’s because they won’t deliver to my work (a very large campus a mere block out of their designated area, and they could make bucks doing so if they just extended it). But this kind of corporate dickery means they will never see any of my money ever again.

    1. Gee Elizabeth West, they wouldn’t chase customers outside of their business model, or more likely outside of their franchise agreement mandated ‘region’. Did they know it was you?

      BTW they seem to be doing OK despite not having your $8.50 / month. 🙂

      1. But its a university, that means hundreds of orders a month from staff and students (if they have housing). It’s not $9 a month. Though the mandate region thing may be due to wanting to open another one in that area so they have 2 instead of 1 and dont cipher off from a close by location.

  2. Not directly related to employment agreements, but fits the “because they can” philosophy…

    I once had a contract that included the clause “throughout the universe”. Yes, really. As if I was going to set up shop on the Moon or in the Andromeda galaxy….

    That contract was not signed.
