In yet another TikTok-exposed scandal, a big law firm partner was caught making out on a park bench with a junior associate. Someone filmed it, it went viral, and the law firm responded appropriately by suspending the partner.
There’s a huge difference between acting when you find out an employee is behaving inappropriately and seeking to find out if an employee is acting inappropriately.
Companies are obligated to investigate conduct that implicates workplace law, policy, safety, harassment, discrimination, conflicts of interest, etc., but they aren’t obligated to put their employees in a surveillance state. And, in some cases, courts have banned employers from looking at an employee’s social media in an attempt to dig up dirt.
